TERMS AND CONDITIONS FOR MEDICO-LEGAL REPORTING
Terms of business
My terms of business correspond to the Model Terms of Engagement for the Employment of Experts (2000) – (copies are available from the Academy Office, 2 South Square, Gray’s Inn, London WC1R 5HP) with the following additions:-
Reports
I undertake to produce a preliminary report within 28 days of instructions assuming all documents are available – in practice most reports are ready within 10 days.
Hourly rate
For report preparation my hourly rate is £150.00.
For conferences and court appearances and any other activity undertaken outside my premises my hourly rate is £195.00 (including travelling time). Any expenses incurred by me, such as travelling expenses, are reimbursable on submission of appropriate receipts by me. Travel expenses are charged as actual first class train fare and/or mileage @ 80p per mile as appropriate.
For court appearances my daily rate is 10 hours.
Payment
Payment is within 12 weeks of invoice.
Cancellations
Any appointment entered in my diary is regarded as fixed. In the event of cancellation with notice within 3 working days, I charge full fee. If notice is given within 7 working days then 50% of fee is charged and 25% within 21 days.

If a client fails to arrive for an agreed appointment, then I reserve the right to charge the instructing solicitor a fee. I will not normally charge this if a client gives me reasonable notice that they are unable to attend a previously agreed appointment. I usually spend time prior to the appointment in reviewing the medical records. In the case of a missed appointment this time will be charged at my normal rate.
Please note the following provisions
Instructing solicitors and agents shall treat all information supplied by Mr Prasad as confidential and shall not disclose indirectly or otherwise use this information except for the purpose of the specified litigation without the prior consent of Mr Prasad.
Mr Prasad’s charges for preparing a report will be based on the complexity and length of the report. - Instructing agents are responsible for giving adequate instructions and shall check that all matters are covered in the reports. Instructing solicitors shall be responsible for any claim made against Mr Prasad resulting from their failure to do so.
- The liability of Mr Prasad to instructing solicitors and/or their clients for negligence howsoever arising in respect of any loss or damage caused by an act of default of Mr Prasad shall be limited to the amount received by Mr Prasad for his services.
- Mr Prasad requires that the instructing agent confirm that the client has consented to examination and disclosure of records if this has not already been done.
- Mr Prasad requires that all of the documents provided for information may be referred to in the report. Please supply a copy of your client’s statement and any pleadings in existence at the present time. Mr Prasad does not store or copy casenotes or other documents and will return them with the preliminary report.
- Mr Prasad requires the instructing agent to arrange to obtain all relevant accident and emergency and specialist hospital notes regarding your client and send to Mr Prasad, Spire Murrayfield Hospital, Thingwall, Wirral CH61 1AU prior to the date of the appointment. Please check that copies of notes are legible and collated in date order before posting. Do not send multiple duplicate copies of notes. If any further investigations are necessary, the cost will be passed on to the instructing agent directly by the hospital. These will not be undertaken without prior approval. Mr Prasad will issue a preliminary report and charge for subsequent review of late presented medical notes.
- Please advise Mr Prasad if notes and x-rays/scans are to be returned and to whom.
- If urgent medical reports are required the reason must be indicated.
- Instructing solicitors shall where necessary obtain prior approval from the Legal Aid Board of Mr Prasad’s charges.
- Instructing solicitors shall pay all sums due within the agreed period of the date of invoice, whether or not the client is legally aided. In the event of late payment, further reports and co-operation will be withheld until payment is received.
- Mr Prasad reserves the right to require advance payment for work undertaken prior to supplying that work to instructing solicitors or agents.
- Fees due to Mr Prasad shall not be subject to taxation by the Court.
